Fish City Charters Gift Certificate Terms & Conditions
Fish City Charters Gift Certificates are a great way to give someone their own Townsville fishing experience. These Terms & Conditions explain certificate validity, value, redemption, transfers and what happens once a Gift Certificate is used to secure a charter booking.
Validity
Fish City Charters Gift Certificates are valid for three (3) years from the original date of purchase shown on the certificate.
The three-year validity period commences on the original date of purchase and does not restart or extend if the Gift Certificate is subsequently gifted to another person or, with the approval of Fish City Charters, transferred to another holder.
A change of recipient or holder does not create a new Gift Certificate or a new three-year validity period.
Certificate Value & Price Adjustments
The value of a Gift Certificate corresponds to the price paid for the specified charter or service at the time of purchase.
For the first 12 months from the original date of purchase, a Gift Certificate issued for a specified charter or service will be honoured in full for that same charter or service, without any increase in price.
After 12 months, but before the Gift Certificate expires, if the price of the specified charter or service has increased, the certificate holder may be required to pay the difference between the original certificate value and the current price of that charter or service at the time of booking.
Alternatively, the original dollar value of the Gift Certificate may be used as credit toward another available Fish City Charters service.
Booking a Charter Using a Gift Certificate
Gift Certificates are subject to charter availability and do not guarantee availability on any particular date.
A charter booking is confirmed only when Fish City Charters has accepted the requested charter date and confirmed the booking with the certificate holder.
Once a Gift Certificate is used to secure a confirmed charter date, the certificate value applied to that booking is treated as payment toward that charter. From that point, the booking is subject to the same cancellation and rescheduling conditions as any other confirmed Fish City Charters booking.
Payment by Gift Certificate does not provide additional cancellation or rescheduling rights.
Cancellation & Rescheduling
More than 7 days before departure
Where more than 7 days’ notice is provided, a certificate holder may reschedule their confirmed charter once to another mutually available date without cancellation charge.
Where the certificate holder chooses to cancel rather than reschedule, the value applied to the booking will be returned to the Gift Certificate, less any reasonable costs or losses already incurred by Fish City Charters in connection with the booking. The original Gift Certificate expiry date remains unchanged.
Between 7 days and 48 hours before departure
Where a certificate holder cancels or requests to reschedule between 7 days and 48 hours before the scheduled departure, 20% of the total booked charter price will be deducted from the Gift Certificate value.
Only the remaining Gift Certificate value will be available toward a subsequent charter. If that remaining value is insufficient to cover the price of a subsequent charter, the certificate holder must pay the difference.
Less than 48 hours before departure
Where a certificate holder cancels or requests to reschedule less than 48 hours before the scheduled departure, up to 100% of the Gift Certificate value applied to the confirmed charter may be retained, reflecting the short notice and the reasonable loss associated with a charter date and vessel that have been reserved exclusively for that customer.
Where Fish City Charters is able to secure a replacement booking for the cancelled charter, this may be taken into account when determining the amount retained.
No-Show or Failure to Attend
Where a certificate holder fails to attend a confirmed charter without prior notice, up to 100% of the Gift Certificate value applied to the booking may be retained.
Repeated Changes to a Booking
Rescheduling a charter does not restore Gift Certificate value previously applied or deducted under these cancellation and rescheduling conditions.
Where part of a Gift Certificate has been applied because of a previous cancellation or rescheduling, only the remaining certificate value is available toward a subsequent booking.
Any difference between the remaining Gift Certificate value and the price of the subsequent charter must be paid by the certificate holder.
Extenuating Circumstances
Fish City Charters recognises that genuine emergencies and exceptional circumstances can occur.
Where a cancellation or rescheduling request results from genuine extenuating circumstances, Fish City Charters may, at its discretion and having regard to the individual circumstances, waive or reduce the applicable cancellation amount or offer an alternative charter date.
This does not create an automatic entitlement to a refund or rescheduling.
Weather & Safety Cancellations
The decision as to whether a charter can safely proceed rests with Fish City Charters and will take into account the weather, sea conditions and other relevant safety considerations.
Where Fish City Charters cancels a confirmed charter because of unsafe weather, sea conditions or other safety considerations, no Gift Certificate value will be forfeited.
The certificate holder may reschedule to another mutually suitable date without penalty. Where a weather or safety cancellation makes it necessary to reschedule beyond the original Gift Certificate expiry date, Fish City Charters will honour the certificate for the rescheduled charter.
Transfers, Sale & Resale
Fish City Charters Gift Certificates must not be sold, resold or transferred to another person without the prior approval of Fish City Charters.
Where Fish City Charters agrees to a transfer, the transfer does not constitute the issue of a new Gift Certificate and does not extend, renew or restart its validity period.
The new holder receives only the remaining value and rights attaching to the original Gift Certificate and remains subject to its original date of purchase, expiry date and these Terms & Conditions.
For clarity, acquiring a Gift Certificate from another person does not provide the new holder with a new three-year validity period.
Refunds & Cash Redemption
Gift Certificates cannot be redeemed for cash or refunded simply because the purchaser or recipient changes their mind.
Where a Gift Certificate has been partly used or had value applied under the cancellation and rescheduling conditions, any remaining value continues to be subject to the original expiry date and these Terms & Conditions.
Expiry
A Gift Certificate must be redeemed within the three-year validity period shown on the certificate.
A transfer, change of recipient, cancellation or customer-requested rescheduling does not extend, renew or restart the original validity period.
Where a certificate holder has made a valid booking before expiry and Fish City Charters subsequently requires that booking to be rescheduled because of unsafe weather, sea conditions or other safety considerations, the certificate will remain valid for the agreed rescheduled charter.
Australian Consumer Law
These Gift Certificate Terms & Conditions operate subject to the Australian Consumer Law.
Nothing in these Terms & Conditions is intended to exclude, restrict or modify any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified.
